From juvenile court to parole hearing : Henry Montgomery's journey through the American criminal justice system

Roe v. Wade (1973) will be consigned to history as the Supreme Court landmark decision that granted American women the right to have an abortion.

What history will probably not remember is that when Norma McCorvey (Jane Roe’s real name) was finally allowed by law to terminate her pregnancy, her child was 4 years old.

Likewise, the Montgomery v. Louisiana ruling (2016) held that sentencing juveniles to life imprisonment without the possibility of parole is illegal. Yet, Henry Montgomery is now 71 years old and has just been denied early release.

This lecture focuses on the Montgomery case, and more particularly on the dark side of the law, “th’opressor’s wrong, the law’s delay” (Hamlet, Act 3, scene 1).

Several perspectives will be analyzed:

The national stance of the Southern States regarding the role of sentencing

Legal precedent as mode of representation of identity claim (Louisiana vs Federal law)

The Montgomery case as an illustration of civil rights violation.
